By Jem Bacchus The term ‘alternative medicine’ that is so commonly used today is somewhat unsuitable since that would seem to indicate that it is a form of treatment departing from so-called ‘traditional’ scientific practices and is just a possibility for a new treatment of disease. The truth is, so called ‘alternative’ medicine is the natural treatment of disease that was in effect in ancient times long before conventional medicine was ever introduced. Alternative medicine is traditional, whereas conventional medicine is relatively new and not traditional. So conventional medicine should rightly be deemed ‘alternative.’ Upon the introduction of conventional medicine, what is now called alternative medicine was suppressed, insomuch that many sufferers are very distrustful of the use of ancient treatments because they have been made to believe that such treatments are ineffectual or even dangerous. Yet, many ancient practices as Chinese, water treatment, herbal remedies, massage and Ayurveda (Indian medicine believed to be the oldest and most complete medical system) are still being practised with great results; and, in recent times, other systems also based upon the ancient forms of natural healing have emerged. These include such therapies as homeopathy, osteopathy, chiropractic, aromatherapy, nutritional medicine, naturopathic, and many other natural therapies that have proved to support the natural healing function of the body with excellent results. In spite of this, there are persons who would prefer to suffer than give such treatments a chance. However, when all else fail, many of those same persons are now returning to such therapies with the hope of finding relief. Although there are different alternative therapies with varying beliefs and techniques, there are common principles under which they are all operating: 1. The body can heal itself naturally and remain stable. 2. Health problems can be contributed to factors of mind, body and emotions. 3. It is more important to get to the root cause of an illness and treat the whole person than to concentrate upon symptoms only. 4. A person can contribute to his own healing if he pays moreattention to his health. 5. The same method of treatment cannot be suitable for everyone since each person is unique in his physical, mental, and spiritual build. This is why two persons may be diagnosed with the same disease and the same level of illness, and one survives and the other succumbs. Your mind can work wonders. The main difference between so-called alternative medicine and conventional medicine is that the latter is too concerned with treating the symptoms of disease by scientific techniques and technology instead of treating the whole person and the cause of disease. On the other hand, alternative medicine puts much emphasis upon the prevention of disease (as mentioned above), and seeks to treat the whole person so as to strengthen the immune system to bring about a sustained healing. Many diseases that have been deemed “incurable” are being healed by natural ‘alternative’ means today but, unfortunately, they have never been heard of by countless sufferers.I enjoy making my own natural remedies from nature’s herbs, vitamins and nutrients. Lender and Receiver Both May Pay For Mismanaged Foreclosure

By John Waller If you deal with receiverships, this case will be of interest to you. A lender, a borrower and a court-appointed receiver have been battling one another in an Indiana federal court in connection with a failed construction project. Problems arose when a partially-constructed apartment complex deteriorated so much during a foreclosure suit that a judge condemned the property and ordered it to be demolished, resulting in damages alleged by the borrower of $4,167,881 (representing the purported value of the property pre-suit minus the value of the foundations of the buildings after demolition). In Judge Philip P. Simons words, assessing who is at fault for this mess is at the center of the action currently before the Court. In rulings filed September 18, 2006 and October 16, 2006, the Northern Districts Judge Simon brought some order to the chaos in case no. 2:02cv368, Four Winds v. American Express Tax and Consulting Services, et al. The cite to the September Opinion, which relates to the borrowers claims against the receiver, is 2006 U.S. Dist. LEXIS 71349. The October Opinion, which addresses the receivers cause of action against the lender, can be found at 2006 U.S. Dist. LEXIS 75581. Lender spanked. The litigation began when the lender decided to foreclose. The borrower filed a counterclaim asserting wrongful foreclosure because there had been no default. The borrower convinced the court that no default occurred, so the court dismissed the foreclosure aspect of the case. The lender then settled with the borrower for a hefty amount on the counterclaims. Receiver faces trial. The borrower also is pursuing the receiver for negligently failing to protect and preserve the project. An agreed order governed the receivers conduct, and the issue is whether the receiver was grossly negligent. The receiver sought a dismissal of the claim by submitting evidence that it did not act with gross negligence. In fact, the receiver undertook at least some measures to protect the property. But Judge Simon ruled that the case must go to the jury to decide factual issues, including: (1) how the project would have faired had the receiver not undertaken the protective measures that it did, (2) how much damage would more extensive protective measures have prevented, (3) why the receiver did not apply to the court for permission to complete the project or for funding to implement more extensive measures, (4) how many times should the receiver have visited the project and (5) whether the receiver was grossly negligent in fulfilling its duties as the receiver. The case is set for a jury trial on February 20, 2007. Receiver v. lender dismissed. The receiver, in turn, had its own negligence claim against the lender, which claim really was about seeking reimbursement for any damages the receiver might have to pay to the borrower. The receiver pointed the finger at the lender, arguing that the lender controlled the receivers actions through the funding (or lack thereof) of the receivership. Judge Simon held there was no legal basis for the receivers position, however, and dismissed the claim. If any negligence-based duties flowed between the parties, they flowed from the receiver to the lender, not vice versa. Thus the receiver, if found to be grossly negligent, cannot recoup any losses from the lender (although the receiver may be entitled to a credit/set-off for the money the lender paid to the borrower.) Interestingly, the agreed order appointing the receiver required the receiver to preserve and protect the property with receivership funds, even though there were no receivership funds to do so because the property generated no income. That catch-22 may have been the propertys downfall. The receiver was responsible for directing the preservation of the property, but on whose dime? Evidently there was an informal arrangement whereby the lender funded the receivership. That went okay at the beginning, but the problems and costs later seemed to snowball out of control. I gather that, if and to the extent the receiver was negligent, it was due in part to inadequate funding by the lender. The confidential substantial settlement the lender paid to the borrower supports my speculation. Lessons. Even though the lender won its legal battle with the receiver, the lender had already lost when the project failed and the borrower forced the lender to settle. There are some lessons here for lenders (and receivers): - Ensure there is a default before a foreclosure case is initiated - Spell out in the receivership order exactly how the receivership will be funded - Clarify in the order the duties of the receiver, and the borrower or lender as warranted - If the lender agrees to fund the preservation of the property, it should take reasonable steps to do so and should not unreasonably permit a project to deteriorate substantially in value But perhaps the greatest lesson is - in cases of construction loans where the collateral is being built - lenders should foreclose and appoint a receiver only as a last resort. By Nancy Wasson Theres an important question that you need to ask the marriage counselor you and your spouse are considering using. The question itself may surprise you, as well as the answer your potential counselor gives. Its an often-overlooked question that hardly anyone ever talks about. Therapists dont include it in articles they write about how to select a good counselor, so youre unlikely to read about it. Ive never heard of the topic being discussed on the popular daytime television shows that delve into so many varied subjects. But the answer to this important question could save you time, money, and energy spent with the wrong therapist. Its a good question to use as a deciding factor if you narrow your search for a marriage counselor down to two or three possibilities, and all look fairly equal in education, training, and experience. What is the question I consider so important that it could be the deciding vote in selecting a therapist for marriage counseling? Here it is. Ask the potential marriage counselor(s): Have you ever participated in extensive personal therapy yourself? Then watch the therapists reaction and listen carefully to what he or she says. Also pay attention to the emotional tone in the response. Consider the following responses to the suggested question. My remarks are in italics in the parenthesis: 1. No, Ive never had to go to counseling. (Never had to go? Do you mean that youre above having to go to counseling? That only people who arent as emotionally stable as you are have to go? How will you even know what its like to go to an unfamiliar office and tell a stranger the most intimate details about your life?) 2. Yes, I went once for several times when my father died. (Thats slightly better, but what about all that self-growth work counselors are always advocating other people do? Dont you take your own advice?) 3. No. (Thats odd. Why the one-word answer? Its a logical question to ask. Why would I entrust you with my vulnerability and something as important as my marriage if youve never been to counseling yourself? Why havent you been? Dont you believe in what youre offering?) 4. I took part in some counseling when I took my courses for my degree. (You mean you role played with other students in some of your counseling classesthat doesnt count. You werent in a real counseling situation and were probably focused on what your classmates and professor thought of your role-playing. Thats totally different from participating in therapy to look closely at your own real issues.) 5. Yes, I have. Ive had several years of intensive personal counseling, and I still see a counselor when things come up that I need to process. I know how much courage and commitment it takes to confront personal issues, avoid blaming others, and take responsibility for the quality of ones life. (Yes, this is the one! He (or she) has gone through the counseling process himself. He wont be just talking about something he has never experienced, and he doesnt sound ashamed that hes had counseling. Instead, he sounds proud of himself for making that choice. I like that he practices what he preaches about counseling. He must believe that it helps in some way or he wouldnt have spent so much time and money getting counseling himself.) Are you surprised to learn that many counselors have never participated in counseling as clients and have never faced their own individual or relationship issues? That they could get their advanced degree and become licensed without having participated in personal growth counseling? It is shocking to think that could happen, but it doesquite often. Just think about itwould you want to go to a therapist who recommends counseling to others but has never taken her (or his) own advice? Who hasnt dealt with her own personal past and present issues that could impact the recommendations she makes to you? Who doesnt really know how vulnerable you feel as a client and how much courage it takes to make an appointment, sit in the waiting room, and then talk openly to someone youve never seen before? I can unequivocally say that you should steer clear of counselors who havent done their own work in counselingeither in individual counseling, relationship or marriage counseling, or both. Theres a saying that you cant take other people any further than youve been yourself. Thats certainly true when it comes to counseling. The counselor needs to be very familiar with the terrainnot from only textbook knowledge but from personal experience, also. He (or she) also needs to be able to help you without getting your issues all tangled up in his own unresolved issuessomething personal counseling helps a counselor to do more effectively. So before you sign on with a marriage counselor, ask the important question–Have you ever participated in extensive personal therapy yourself?and be sure that the counselor you select knows the advantages of personal counseling first-hand. The number of obese people increases not only among adults, but also among teenagers. Where does obesity springs from? Today it has become obvious that eating is not just a physiological response. The contemporary world and life style provides plenty of reasons for being overweight: stress and depression, irregular meals and lack of exercises, unhealthy food and absence of time for proper rest. Studying craving for food in obese patients, scientist have found specific areas of brain to be responsible for appetite. It entailed the idea of appetite suppression by affecting these brain circuits. The stimulants aimed at reducing hunger and by that controlling weight are called amphetamines. They are supposed to have addictive potential if taken during a long period, therefore are available strictly on prescription. In general, all available in the market appetite suppressant drugs may be divided into two broad pharmacological categories: those affecting through catecholamine pathways and those which affect through serotonin pathways. The drugs related to appetite suppressants include phentermine, which has been proved to reduce hunger and lower food consumption thereby helping obese people to keep to a low-calorie diet. As a result Fenfluramine and Dexfenfluramine were withdrawn by FDA September, 1997. Note, that FDA did not request to withdraw Phentermine. Today phentermine is legal and allowed on prescription. Currently it as available under the brands Ionamin and Adipex-P in drugstores and online. The newest cocktail containing phentermine is Phen-Pro. It is considered to not to cause the problems resulted from taking Fen- or Dexfen-Phens. Pro is from Prozac, which is one of the following antidepressants: Calexa, Zoloft, Trazadone, Luvox and Effexor. This constituent is needed to enable better work of phentermine during longer period of time and has no relation to depression. Finally you should know that phentermine is an effective drug for obesity treatment available at a reasonable price. But it by no means substitutes proper diet and training. It is efficient only in conjunction with a low-calorie diet and exercises. Most teachers of foreign languages Ive met dont teach it this way, but thinking in a foreign language and translation back andforth between different languages are really different skills — and thinking in the foreign language is much easier! If you think about this for a moment you will discover the truth of it. Think of what happens to the average person who takes aclass in a foreign language. S/he usually gets caught up intrying to translate everything s/he hears into her own nativelanguage, right? Perhaps you have even had this experienceyourself. Now think of the average person who doesnt know theforeign language, but moves to a country where everyone is usingthe foreign language. How quickly does s/he acquire a great dealof fluency in that language? Really fast, right? S/he islearning the language in context, much like a child learning hernative language, so s/he isnt slowed down by the act oftranslating. S/he creates direct connections in her mind betweenideas and the words in the foreign language. Its like thedifference between taking the bullet train to yourdestination rather than taking a slow train with frequent stopsand train changes. When you allow yourself to let go and think in the target language and just speak from your thoughts, youre going to havereally great results. Many students try to translate and thenspeak, which makes speaking exponentially more difficult. Thesame thing happens to me even with my own native language by theway. If I think something in Japanese, my second language, andthen try to translate it into my native language of English, theinitial result is often a choppy mess of very awkward English! There is nothing wrong with translating; its just a completelydifferent skill. Though it is an important skill to have, and isuseful for certain things, you are probably going to find thatwhen speaking you get much greater results from choosing thedirect route of thinking in the target language, and then simplysaying what you are thinking. I encourage you to go ahead andthink in the language that you want to speak in and get ready tobe surprised at how, almost instantaneously, how much morefluent and brilliant you are.
